Federal Information Blocking Requirements
Who do the regulations apply to and what do providers (and their health IT vendors) need to do? New CMS regulations prevent healthcare providers from “information blocking,” or interfering with access or exchange of ePHI, and require that providers identify all potential “information blocking” practices. This talk will discuss such, including requirements that hospitals must use “reasonable efforts” to collect the information required and send ADT notifications to post-acute care service providers and suppliers as well as to primary care and other practitioners with whom the patient has an established relationship, that hospitals determine what access parents can have as to minor records, that providers not delay the release of test results, etc.
